Print & Mail Product Terms

Welcome to PrintWorthy. By accessing or using our platform, creating an account, or sending any mail through our service, you agree to be bound by these Print & Mail Product Terms ("Terms").

If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including subscribers on Free, Starter, Pro, and Business plans.

You represent that you are at least 18 years old and have the legal authority to bind any organization on whose behalf you use the Service.

PrintWorthy is a platform that enables you to create, preflight, and physically mail newsletters and postcards to your recipients. The Service includes design tools, recipient address management, address verification, deterministic PDF generation, and physical mailing orchestration through our mailing partners.

Subscription plans include a set number of included mailings per month and discounted per-piece pricing for additional mailings. The Free tier operates on a pay-per-mailing basis with no recurring subscription fee.

We reserve the right to add, modify, or discontinue features of the Service at any time, with reasonable notice to active subscribers when material changes affect billing or core functionality.

You must provide accurate and complete information when creating your account and maintaining your profile. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

You must notify us promptly of any unauthorized use of your account. We are not liable for any losses caused by unauthorized access to your account.

Each organization should maintain a single account. Sharing account credentials across users is prohibited.

You agree not to use the Service to create or send any of the following types of content:

• Content that is illegal, fraudulent, or violates any applicable local, state, federal, or international law;

• Content that is threatening, harassing, defamatory, or invasive of another's privacy;

• Content that is sexually explicit or contains depictions of sexual violence;

• Content that infringes the intellectual property rights, privacy rights, or other proprietary rights of any third party;

• Content that is deceptive, misleading, or intended to defraud recipients;

• Content that promotes discrimination, violence, or harm against any individual or group;

• Content that violates USPS Postal regulations or any applicable postal mailing restrictions.

We reserve the right to refuse, suspend, or cancel any mailing or account that violates these policies, without prior notice and without liability to you.

You are solely responsible for ensuring that all mail sent through the Service complies with applicable postal laws and regulations, including but not limited to United States Postal Service (USPS) rules, the Domestic Mail Manual, and any applicable international postal regulations.

You must have proper authorization to send mail to each recipient on your mailing lists. You are responsible for honoring opt-out requests and do-not-mail preferences.

All return addresses used in your mailings must be valid and accurate. We verify recipient addresses, but address verification does not guarantee deliverability. We are not responsible for mail returned to sender due to invalid or outdated addresses.

You acknowledge that the USPS and other postal services may inspect, delay, or refuse mail at their discretion, and that delivery timelines are estimates, not guarantees.

All content submitted for mailing must meet the technical specifications required for physical printing and postal processing, including size, weight, bleed, resolution, and color standards.

PrintWorthy generates print-ready PDFs through a deterministic rendering process. You are responsible for reviewing and approving all content before submitting a mailing.

We may reject content that does not meet technical requirements or that would result in a failed or returned mailing. In such cases, we will notify you and provide an opportunity to correct the issue.

You are responsible for ensuring that you have obtained all necessary consents and authorizations to send physical mail to the recipients on your lists, and that your use of recipient data complies with all applicable data protection laws, including the CAN-SPAM Act and any state privacy laws.

PrintWorthy processes recipient data solely for the purpose of fulfilling your mailing requests. We do not sell, rent, or share your recipient data with third parties for marketing purposes.

You retain ownership of your recipient data. You grant PrintWorthy a limited license to process this data as necessary to provide the Service, including address verification, PDF generation, and physical mailing through our mailing partners.

We implement reasonable security measures to protect your data, but no system is perfectly secure. You are responsible for maintaining backups of your recipient lists and content.

Subscription plans are billed monthly on a recurring basis through our payment processor. Your subscription automatically renews each month until you cancel.

Each paid plan includes a set number of postcard and newsletter mailings per month. Included mailings reset at the start of each billing cycle and do not roll over.

Mailings beyond your plan's included volume are billed at your plan's per-piece rate. These charges are processed automatically through your payment method on file.

The Free tier has no recurring fee; each mailing is billed individually at the standard per-piece rate.

Applicable taxes are added to all charges where required by law. You authorize us to charge your payment method for all fees incurred under your account.

PrintWorthy may offer coupons and promotional codes from time to time. Coupons are subject to expiration dates, redemption limits, and other restrictions specified at the time of issuance.

We reserve the right to modify, suspend, or cancel promotional offers at any time. Coupons may not be combined with other offers unless explicitly stated.

Abuse of promotional codes, including creating multiple accounts to redeem single-use coupons, may result in account suspension and invalidation of associated coupons.

Subscription fees are non-refundable except where required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing cycle.

If a mailing fails due to a PrintWorthy error (not due to invalid addresses, prohibited content, or postal service issues), we will credit your account for the failed mailing or re-send at no charge.

Refunds for undelivered mail are subject to the policies of our mailing partners, and the applicable postal service. We will assist you in filing claims where applicable, but we do not guarantee refund outcomes.

We strive to maintain high availability but do not guarantee that the Service will be uninterrupted or error-free. We may schedule maintenance windows with reasonable notice.

Physical mail delivery times depend on the USPS and other postal services. We provide estimated delivery windows but cannot guarantee specific delivery dates.

We are not responsible for delays or failures caused by postal services, weather events, natural disasters, or other circumstances beyond our control.

You retain all ownership rights to the content you create and send through the Service, including newsletter text, images, designs, and recipient data.

PrintWorthy retains all ownership rights to the platform, including the design studio, PDF rendering engine, address verification integration, and branding tools.

You grant PrintWorthy a non-exclusive, royalty-free license to process your content solely as necessary to provide the Service, including generating PDFs, verifying addresses, and transmitting mail to our printing and mailing partners.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that mailings will be delivered, that addresses will be valid, or that the Service will meet your specific requirements.

We do not warrant that the Service will be error-free, secure, or available at all times.

To the maximum extent permitted by law, PrintWorthy's total liability for any claim arising out of or related to these Terms or the Service shall not exceed the total fees you paid to PrintWorthy in the twelve (12) months preceding the claim.

In no event shall PrintWorthy be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

We are not responsible for lost, delayed, or misdelivered mail, or for any actions or inactions of the USPS or other third-party service providers.

You agree to indemnify and hold harmless PrintWorthy, its officers, directors, employees, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your content, including claims of intellectual property infringement or defamation;

• Your violation of these Terms or applicable laws;

• Your use of the Service, including any mailing sent through your account;

• Your violation of any third-party rights, including recipient privacy or do-not-mail preferences.

These Terms are effective from the date you first use the Service and continue until terminated.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing cycle.

We may suspend or terminate your account at any time for violation of these Terms, for non-payment, or for any conduct that we determine may harm the Service or other users.

Upon termination, all outstanding charges become immediately due. You will not receive a refund for the remainder of the current billing cycle unless required by law.

We may update these Terms from time to time. We will notify active subscribers of material changes by email or through the Service.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you may cancel your subscription.

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts having jurisdiction over PrintWorthy's principal place of business.
